What are Catch Shares?

What are Catch Shares? In case you never heard the term, we want to spend a few minutes telling you a story. It is a political story, and as such might be something you think has no place in the world of sport fishing. But if you do, you're wrong. Because politics - large scale, global, high-dollar politics - are every bit a part of the world of fishing as they are the world of oil, the world of health care, or the world of the environmental protection agency, and in turn our federal government. If you fish it is time to start learning about a clear and imminent danger to our way of life. It is called Catch Shares.

Catch shares are simple to understand. But before we define how they work, realize that the environmental movement is now more than 20 years old. The radical among the movement feel that mankind, in it's rush for gold and oil and i Pads, is destroying the earth. It has gotten to the point where the United Nations recognizes mother earth as a being, with every right granted to the humans that live on her skin. Look; I am as kind to the environment as anybody I know. In fact, it is the anglers, hunters, and outdoors people I know that are the true conservationists, not the pale-skinned tofu-slurping vegans whose idea of the great outdoors is a channel on cable tv called the Animal Planet. But the earth is our home. We need to keep it clean but we are the dominant species. We do not belong controlled and wrapped in little dream cities.

We belong outside, and benefit from tribal politics. We protect our own. It is human nature, not dirt and rocks with human legal rights. There is no fairness except that provided by the law. Law it not controlling our fisheries; regulations written by people who think we are less than intelligent for wanting to kill those poor little fish are and have been controlling our sport. After all, you can watch them on tv! Why in science's name (their form of God) would a civilized person rip those innocent creatures from their homes and EAT THEM?????
But make no mistake about it, ladies and gentlemen. It is the tofu-eaters among our regulatory bodies that are making the rules now changing our lives. When I was a kid, tarpon tournaments resulted in thousands and thousands of dead tarpon hung from the porches and roofs of public buildings and colleges. Despite that devastating and environmentally unconscious introduction to the beauty for sport fishing for the Silver King, the sport - and the fish - are alive and well.

Today we cannot catch gag and red grouper, and American Red Snapper are so abundant that they are driving grouper off their natural reefs. But out of our reach.  Little wonder the gag and red grouper counts are down. Jewfish, now politically-corrected to the label "Goliath Grouper", eat ten percent of their weight a week. A four-hundred pound grouper that eats forty-pounds of gags and reds for lunch. But they are protected, and now so, too, will be their food sources. And didn't a Jewish kid kill that Palestinian? Isn't that the story, and isn't Bill Ayres and his wife and code pink sponsoring flotillas to protect Goliath offspring?
Regulations and the environmental left are and have been completely out of control. They do not fish, but regulate our fisheries. They believe in their form off science, and silence other voices. And they are destroying our angling way of life. You want proof? As the mayor of Madeira Beach, Florida, Travis Palladeno watches his business and life fade away. Regulated away. His city, far from becoming the utopia Vibrant Coastal Community envisioned by former EDF board member Jane Lunchenco (now Obama's Director of NOAA), it is on dry dock, and dying a slow death. They were the sports grouper fishing capital of the world. Now they are dry docked. The families cast asked for the protection of abundant fisheries.


Catch shares

So onto our definition of catch shares. Catch shares are a set of regulations where by the government and their globally-warmed scientists count the fish. Since they do not go on the water, that use computer models. Right now the computers tell them that the recreational angling community is killing all the grouper, so using what is called precautionary science, they shut us down. The grouper are there, but the computer models do not see them. Like they failed to see the clouds covering our planet in the computer models that warned of imminent global heating to the point of global death of all things living.
Once they count the fish, they, in their infinite wisdom, distribute them. Or we should say redistribute them. Some go to the commercial guys, some to captains and head boats, and some to us. Us regular Jo's with boats bought with money we earned. The taxpayers who support the recreational industry in all it's forms and reach. In Florida, that is $50 billion a year according to reliable statistics.

We come last. First comes the commercial boats (Tyson foods, anyone?). While shutting down half of our national fleet with over-regulation, Walmart has been gobbling up the paperwork - called Individual Fishing Quotas- that will let them populate many  boats all those independent fishing families lost as a result of the overwhelming number of new "environmental" regulations. They have given millions from their "foundation" to the tofu tr-sexual regulating us off the water. And it is going to be at Walmart you will have to go and buy your government permission-ticket before going out to catch those (now safe) grouper. If you buy a ticket and you don't catch any that day? Or the weather stops you before you reach your fishy spot? Too bad. Next time you go, you buy a new permission ticket at Walmart. And if you think there won't be flounder and redfish tickets at the same place in the same aisle soon after the grouper tickets, you are out of your mind. Let a camel into the tent, and their nose makes room for their humps.

Hold your nose and follow the money

One more thing on catch shares. There is only one protein food source you cannot yet buy on the Chicago Mercantile, where the values are determined for the future prices of the world's commodities. You can bet on the future price of everything from pig bellies to cows to natural gas. But there is one thing you cannot bet on. One thing still a public resource. Fish.
Think about it. The argument that catch shares are "an effective tool in the hand of scientists and other government officials responsible for managing our fisheries" nonsense. What it is is a thinly veiled strategy to move money and power. Catch shares can be made to sound perfectly sensible. Until you smell the stink of corruption. Some $70 million in money is being moved around between tax-exempt organizations, and the threat to our freedom is obvious. If you want something on the Mercantile, you have to first allocate it. Who better than people who think that having goldfish as pets should be illegal? Do not laugh. Check city law in San Francisco, California. Give it some time and you will be paying for those goldfish police.

Catch shares have drawn millions of dollars in support from groups like Walton, Alyson foods, PEW, EDF and George Soros' Tides Foundation (among a dozen other like-minded and globally-sympathetic nongovernmental organizations, why not follow the money? If we follow the money, we might find the truth. Is mankind killing the fish, or are they just another collection of victims? Because causes needs collections of victims.

As a freshwater and saltwater trade association, ASA claims it “represents the interests of 60 million anglers,” even though the organization has historically taken a mostly ‘hands off’ approach to working with individual anglers and their most pressing concerns. Between Catch Shares, marine spatial planning and sector separation one would think that money talks and the bullshit walks but in the ASA's point of view, they do not mind losing millions of dollars in the long run; why is this, a pay off?

Captain Sid Preskitt: the threat to American fishing industry by government

My friend and colleague, Captain Sid Preskitt, talks the truth in just what is really going on within our fisheries and the downsizing of our American Fisheries through United Nations protocols. Federal Policies signed in by "Executive Orders" to establish just who is allowed to fish in the commercial industry. We do need a trade policy that protects our fisheries from unfair trade practices, as well as from cheap imports from nations that don't abide by the same environmental standards we demand from our own fisheries. As important, we also need trade negotiators with the level of sophistication and competence to recognize differences in forms of government fisheries assistance -- between those leading to bad practices, such as overfishing, and those designed to help fisheries, such as with stock rebuilding or improving safety at sea. NOAA REQUESTS $54 MILLION TO REDUCE FISHING EFFORT
 RFA Says Agency Seeking Congressional Aid to Destroy Fishing Communities
 
In a bold attempt to take control of our nation's coastal resources, NOAA Fisheries has asked Congress for an additional $54 million in funding for catch shares, while simultaneously turning their back on the agency's scientific deficiencies in managing marine fisheries.
 
While Atlantic and Gulf Coast fishermen and legislators have openly rallied in opposition to this particular takeover scheme, NOAA Fisheries, led by an agenda-driven ideology to reduce fishing participation, continues to run roughshod over coastal constituents in clear violation of legislative order.
 
Appearing before a House Resource Committee hearing on October 26th in Washington, Recreational Fishing Alliance (RFA) executive director Jim Donofrio blasted the NOAA administration for failing to adequately fund scientific efforts in coastal fisheries management. "NOAA claims they don't have enough money to do the stock assessments on the species they manage," Donofrio said in his official testimony, explaining how there are boats tied to the dock in coastal communities throughout the United States right now, unable to access healthy, rebuilt fisheries due to lack of science.
 
When the Magnuson Stevens Act was passed by unanimous consent in the Senate in 2006 and signed by President Bush in 2007, it required NOAA fisheries to overhaul their Marine Recreational Fishing Statistical Survey (MRFSS) by a time-specific deadline of January 1, 2009. Donofrio said NOAA officials have publicly stated on several occasions that a new Marine Recreational Information Program (MRIP) has not yet been implemented, despite the requirements set forth by Congress.
 
"Right now we don't have a data collection program that Congress mandated in the 2007 Reauthorization for marine recreational statistics, the new MRIP program," Donofrio told Congress in October, adding "they're still using the MRFSS data and they're shutting down fisheries based on the MRFSS data."
 
Despite the woeful lack of science and analytical data needed to properly manage fisheries, NOAA has apparently gone to key members of the House and Senate in asking for additional funds for catch share programs which by design cap fishing participation by trading away ownership of fish stocks to select groups and individuals. Earlier this year, NOAA's administration under the leadership of Dr. Jane Lubchenco had attempted to misappropriate several million dollars away from NOAA's scientific budget to allocate towards catch shares, a move which was stymied by an act of Congress.
 
In February, the House voted 259-159 to cut off funding for future catch share programs which would've opened the door to commodities trading of fisherman’s catch allocations - or worse, a complete buy-out of angler access by preservationist groups. The bipartisan budget amendment tied to NOAA's proposed catch share funding was sponsored by Republican Rep. Walter Jones of North Carolina, as well as a pair of coastal Democrats in Rep. Barney Frank of Massachusetts and Rep. Frank Pallone of New Jersey.
 
"We've heard from Congressman Jones this week who says that NOAA is courting legislators, asking for more money for catch share programs," Donofrio said. "These are the same programs that have driven Massachusetts legislators to seek $21 million in directed economic relief from Washington to give to displaced fishermen, specifically because of these failed catch share policies enacted under the present NOAA administration."
 
A letter co-signed on October 31 by 19 bipartisan coastal members of the House of Representatives calls on ranking members of the House to ensure that language is included in the 2012 appropriations bill which would restrict the use of funds for development or approval of new catch share programs for any fishery under the jurisdiction of the New England, Mid Atlantic or South Atlantic Fishery Management Councils.
 
"The last thing the American government should be doing in these economic times is spending millions of taxpayer dollars to expand programs that will be put even more Americans out of work," the letter says, explaining that that is exactly what NOAA is attempting to do by requesting $54 million it its 2012 budget, "to accelerate implementation of new fisheries catch share programs across the U.S."
 
Donofrio said the RFA has already spoken to ranking members of the Senate who will be cosigning their support of the letter, and added that he and fellow fishermen will be reaching out to legislators in the Gulf of Mexico to rally support in opposition to catch share programs which take monies away from scientific efforts in that region.
 
"By commoditizing a public resource and placing share distinctions on individual fishes, what the catch share policy would do is give big corporations and wealthy non-profit groups the ability to buy up all the harvest for themselves, leaving individual anglers and coastal communities standing at the dock with nothing," Donofrio said. "This whole orchestrated effort by Dr. Lubchenco and her friends at Environmental Defense Fund is nothing more than a resource grab which will destroy our marine industry and take away access for millions of Americans."
 
"I can't fathom how Dr. Lubchenco can claim to support best available science when her Administration is asking Congress for money, not to improve stock assessments and data collection, but for coastal sharecropping schemes which will destroy our mom and pop businesses along the coast," Donofrio said.

Wasting Your Money; Climate Change/Catch Shares!

Remember just how effective NOAA was during the Gulf Oil Spill? What about its fame to incompetent management through the corrupt and disposition of funds generated by fines and property seizures from fishermen? Climate Change Scares to Catch Share Ponzi schemes sponsored with your money by and for privileged industry like the EDF; why is that?



Dr. Jane Lubchenco, the environmentalist rock star and former vice chairperson of the Environmental Defense Fund (EDF), was appointed as the administrator of NOAA by President Obama. She has installed a team of Eco-zealots, and they have a Climate Service Office ready and waiting to proceed ,with only congressional approval standing in their way, too which has not happened even though she has already spent monies in creating the positions needed to run her Czar creation of feudalism on the fisheries. The six regional directors were appointed on 10 September 2010. All the elements promised by Dr. Lubchenco are in place, even though Congress said “NO,” she is ready anyway. Wonder what that is costing us in tax dollars? The FY2011 Continuing Resolution, set by Congress, also prohibits expending funds on specific fisheries management techniques. NOAA’s response: issuing a legalistic Ziggy-zagging on parsing and hairsplitting, to find ways to fund their games.

Remember the article about sea level rise along the Maryland shore? It was another “Best available information” they could get as there was not any scientific data to back up such. A great Shock & Awe or article to catch the human eye of fear in gloom to doom; kudos to a great fiction story but to how many believed this garbage? The article appeared in the Climate Watch Magazine, which is a feature of the NOAA Climate Service web portal.


The apple falls not far from the tree and as Dr. Jane Lubchenco, was, is or whatever still has involvement with EDF, one of her founders and EDF are the extreme of environmentalist positions. EDF tool of choice for fisheries are “Catch Shares” or also referred to as Catch Shares Management and sometimes derisively termed as a cap and trade but to whatever you call them, “Fisheries are depleted and fishermen lose their jobs as “Catch Shares” march forward making monies for those whom are called stock, I mean, stakeholders. Now to those who do not know what a Catch Share is, here is a quote from Wenonah Hauter, of Newsvine.com, “A means to essentially privatize fishing, catch shares divide up the fish in any given region, often granting fishing privileges to a handful of larger corporate interests while pushing out smaller-scale, more traditional fishermen. Since they award those operations that fish the fastest and hardest, they incentivize the use of larger-scale boats, more damaging gear, and wasteful fishing practices that hurt fish stocks and the habitats on which they depend.”


If EDF loves NOAA and its position on its flawed data to best information and science, EDF ought to take it over with in the private sector and Congress could release NOAA from its purse strings, to which they would gladly do except our fearless leader, President Obama to is in bed with this Cap and trade bunch. We must tell Congress not to allow NOAA to regroup and we must make sure President Obama will be what I want to be; a one termed official! He had his time in and his colors are not that of my red, white and blue, as I stand for the American Fisherman, the Constitution and the use of God everywhere freedom rings through-out our Republic! Hell No to Catch Shares and Hell No to those organizations which stand by them. Not in my country, not in my town and not on my oceans are the speech of Americans everywhere. Catch Shares to Climate Change, sell it to China as they may be in need of a Eco-zealot environmentalist rock star, to motivate them into a Catch Shares Management Program, as we here back in America are not into another Cap in Shade deal to steal our rights to jobs to fish for the advancement of board members of the EDF on my dime!

The Dupping of America: BOYCOTT WALMART

Watchdog group's report says $1B in government subsidies have aided the retailer's expansion. http://money.cnn.com/2004/05/24/news/fortune500/walmart_subsidies/ uses taxpayer dollars to create jobs that tend to be poverty-wage, part-time and lacking in adequate healthcare benefits." And that 75% Full-time jobs they boost of at the end of the article, represents 28 hrs a week plus, you get Full-time status. Full time part time job no wonder you can't afford 35 dollar a week health insurance at minimal wage.

These names look familiar? Ocean Conservancy, Conservation International Foundation, Marine Stewardship Council, World Wildlife Fund and Environmental Defense Fund (EDF). Well they should, your friendly Wal-Mart announced "investments" totaling more than $71.8 million awarded to them, last year in “Buying Up Your Fishing Spots!” An additional 36 million handed over this year to help in the lock down of Privatization of the Oceans of the USA. And you thought they just sold fishing equipment for a profit. Those rod and reels to baits and lures are angling to own a piece of that water you fish and then lease it back to you at a “Roll-Back” price. Catch Shares are catching on in Congress so President Obama and his Yellow brick Road Club, led by Dr. Jane Lubchenco, keep changing the names, to protect their self-interests. With Agenda 21, it started with ICLEI then changed to Smart Growth, then to Sustainable whatever and so on but with Catch Shares we now have the so called "marine protected areas." That could be somewhere to every where! A Cover it all phrase that smells of Pew Charitable Trusts, who has billions in reserve to fight for its right to own your ocean. I'll bet PEW to EDF will not back my campaign in The Right To Fish because I FISH and I VOTE! Even if I am only testing the waters for US Senate, Florida, I'll take a broadside before I'd take a dime from those scaly wags!

Walmart gets millions to billions in Subsidies, YOUR TAX DOLLARS, to sell you sweat labor and ruin your neighborhood. Take away your community, take away your fish, and use that word "Sustainability" code word for Agenda 21!

If we as Americans want to save money and buy American Products then we need an all out Boycott of Walmart Stores. Those Roll-Out Prices you are paying for with Government Taxpayer Subsidies. You didn't think they were just cheaper because they are big, did you? They are the biggest Union Busting giant around and they are King of the Hill! Look at our state of Florida where if you work for them, it's either part time, no health benefits or full time and you cannot afford what they offer, so you are now eligible for Medicare. Florida has almost all of its Walmart Associates on your dime, so they can make more money off you...and you let them, by buying there every day? Why? Let's watch the pigs fly and all boycott Walmart as they do not own me, my neighborhood or the fish in the ocean!

Ma Bell to Standard Oil Company were both busted as Monopolies as such, they are not allowed by law, going back to the railroad days of the frontier. Walmart is but a large Chinese Company with an American Name and an American Family taking advantage of hard working Americans in selling predominantly foreign products to Americans. Walmart is but a conduit to the capitalism in this country to which they have not a clue! Now, that Walmart has put many a small business down, they are going after the fishing grounds to which is or was American owned. The communistic manifesto of America; AGENDA 21


WE WILL WIN BACK WHAT HAS BEEN STOLEN FROM THEE! HEED THESE WORDS:
The truth shall set us free as a people and a nation again! All to whom worship our Stars & Stripes,it is bipartisan by nature, as Americans all are called upon to rid this nation of the creeping evil at our back door. Agenda 21 and to all that follow in its footsteps, in a running down of our beloved America, I say NO! You will not trample on our Bill of Rights, Constitution, ways to which we work and play. Dictation of our fisheries to fishing with our children will not be taken away; President or not; you will not trample on my rights as you already have the American People. Why do you lie? Has agenda 21 consumed your soul too?

Help us in our fight for the right to fish and live free in the land we call the United States of America. The media is afraid of it so much they refuse to talk about it and maybe it will just go away? Follow me as our leadership grows in the colors of Red, White and Blue.

Americans and the American news media are all but ignoring the shenanigans by those who worship at the altar of the United Nations. The big story these days is the conflict between the U.S. Congress and President Barack Obama over the proposed debt ceiling increase, cuts in spending and the Democrat Party's favorite activity: Raising taxes on the rich. The real problem, is with the media's coverage of this United Nations labyrinth known as Agenda 21. Created in 1992 and implemented in incremental actions by the U.N. and its supporters in the U.S., E.U., and other countries whose populations are eager to benefit from the work of others especially those enjoying success in the United States.

Congress never approved the implementation of Agenda 21 programs in education, economics, the environment and other areas and though other presidents have recognized this scurvy to a scorched earth policy, President Obama, at the end of the Lame Duck session of Congress in January, as all were going home, did the Senates job for them in ratifying the LOST Convention or as we know it Agenda 21 of the Land of the Sea Treaty!

Agenda 21's, International Council of Local Environmental Initiative, ICLEI, have made deals with local governments numbering upwards of 600 cities, towns across the USA now in a step that ignores the Constitution in that these cities have made a pact with the devil, so to speak, as cities to States may make no concessions with foreign governments what so ever. The Feds have ignored it too and they are found in contempt of the law of our land. Proponents of Agenda 21 are not limited too but these are the big boys at bat: billionaire George Soros has provided millions of dollars to ICLEI. The truth is, Agenda 21 promotes European socialism that by its nature will infringe upon our freedoms and liberties. Most of its vague, lofty sounding phrases cause the average person's eyes to glaze over, making it easier to sneak into our communities. Phrases like GreenPrint, Sustainability, sustainable growth, sustainable environments and such that look to sound good until you look inside the box! As a radical environmental agenda, the U.N. wishes to change consumption patterns, including ownership of property and automobiles all the while, successfully promoting social justice. In the United States, the Agenda 21 National Coordinating Body is the President's Council on Sustainable Development (PCSD).

The U.S. Constitution requires that consensus on public policy be hammered out in public by elected officials, not by 28 appointed individuals, carefully selected because of their known support of the principles expressed in Agenda 21. This UN description of the PCSD is found in a section of the report entitled "Integrated Decision-making," also known as the "consensus" process. Just look at the Executive Orders Obama has passed without Congressional consent! Yet nobody talks about it, with the exception of I. As I stand here before you today and say NO TO AGENDA 21! The progressives laid the foundation for Agenda 21 in the 1960s when it became unlawful to pray in government schools. Now, as of this week, because it may offend the Hispanics of our country, these same progressives are trying to ban the US Flag from flying in schools to government buildings. If they do not like my stars and stripes to which my great, great, great uncle wrote “The Star Spangled Banner” they can leave!

Just as they crept into our schools, they used Magnuson-Stevens in its loop-holes in the upper Northwest in planning catch shares to sector separation on the salmon. Do you know that when our country is at its knees with the debt and default hanging overhead, President Obama recently offered 500 million dollars to any school to whom kicked out the ABC's and implemented Environmental Education as an alternative to regular studies K-12; with an Environmental Literacy test administered at the end of your schooling. Regardless of your grades, pass the Environment test and collect your reward of a H.S. Diploma? Part of the Environmental studies is on Marine Spatial Planning, Sector Separation and Catch Shares. Inquiring minds want to know! "EDF is now pulling all forces and funding to target the Gulf of Mexico as their model for catch shares. They view the Gulf as the prize and will stop at nothing to eliminate fishing and jobs."If all are taught this, a brain washing occurs to which one would no not the difference between freedom and the communistic manifesto of the fisheries.


Agenda 21 embraces virtually every aspect of human life; it is being implemented aggressively in the United States. Congress has never examined the totality of the Agenda. Instead, The ultimate objective of Agenda 21 is to establish "international norms" of personal behavior that are dictated by a handful of the world's enlightened elite, the councils, who believe they know best how people ought to live, fish and travel, therefore they should be allowed to tell people how it is, as indoctrinated in LOST, Agenda 21.

"Catch Shares A Disaster" Says Mayor Lang; Bedford Mass.



It's Just that Simple; THEY DO NOT WORK but the fisherman do want to work. Why is OBAMA putting them out of business?

Every year, by law, NOAA puts out a fisheries report to the Congress. This is NOAA's chance to show off in the very best light. Table 1 of NOAA's annual report to Congress on the 2009 Status of U.S. Fisheries covers 522 fish stocks. Twenty-three percent of the most important 230 stocks have no data, being termed either "unknown" or "undefined." Is this what we have to show for forty years of effort -- a three-quarter understanding of our important fish stocks? Overall, of the 522 stocks, 51% have no data. No data on over half of the fish stocks, and this is our best available science?

Catch Shares; Pure Social-economic Communism

The Cold war may have ended, the wall in Berlin, came down but to my dismay, communism is but slowly creeping into our countries schools, businesses and marine industries. In communism, the State is the big cheese, no God. In fact, God disappears. It is the first step and think about it, we have taken God out of our lives because of why? It offended someone, a communist or other factor of a non-believer. Well gee-whiz guys, that is your problem. When you come to my house, I expect respect and follow my rules and the same if I visit yours. If you do not like it, leave. We as Americans were brought up this way by the Whig Party; Herbert Hoover changed it to “The Founding Fathers” during his reign of power. It sounded better and if Hoover said it, it was gospel, as he too believed in God! Then after we started removing “God” out of all public places, we started implementing Catch Shares, Sector Separation and spatial planning.


As you may know, I am against CATCH SHARES, COMMUNISM and ALL THAT WOULD BRING OUR COUNTRY DOWN. I FISH I VOTE! I am an Exploratory Candidate for the US Senate FL 2012 and I need you to help me in our fight for our fisheries, God and The Red, White and Blue; America! “Catch Shares do nothing to a fishery except put the "Big Operators" in charge, resulted in the exclusion of those with small operations to smaller boats vs a fleet, and that aggregation of quota to large interests deprives their local coastal communities. Small fishing operations, who once could fish by a common right, were now out in the cold, stuck at the docks in battling corporate interests who turned the fisheries into a commodious international market, not of free enterprise or capitalism but a form of pure social communism! The purpose of catch shares is to put independent businessmen out of business and does nothing to save a fish. So how come our government lies to us? Can you say money.

The Feds are in trouble but Agenda 21, communism, is not the answer. Let the States regulate their own fisheries and let the Federal Government shrink back to a nominal size, to which it can then control its self! Catch Shares are nothing but a surf minding his stock of wheat to fish, until the Lord comes for his piece of the action or as share croppers, you get to fish but I own the fish. This is wrong as the only one who owns the fish is God, who gave us the right to catch them, not sacrifice many a good hard working family to that of a corporation in the name of greed.

Dr. Jane's Slips Up; “Catch Shares Voluntary!”

NOAA Chief Dr. Jane Lubchenco said and she went out of her way to emphasize, that “catch shares are a voluntary choice, made by regional councils that include members from the industry.” According to a “Story from World Fishing Today,” where Dr. Jane stated that 1/5th of her $5.5 billion NOAA budget goes towards the fisheries. New additions, riders, were attached to the bipartisan bill, launched initially by Congressman Walter Jones, that would allow the National Oceanic and Atmospheric Administration to continue spending on the controversial fishery subjects. These new earmarks were added by the the House and Senate Appropriations committees. The Catch Shares budget, 36 million dollars, was shut down, as of recent but it is a small fraction to the amount NOAA is planning on futures of this fishing game as NOAA is on dead reckoning towards commodities, the fish market, coupled with private foundations in buying, selling, leasing and trading "shares" of allocated catch limits (ACL) among themselves, corporations and outside investors. Smells to me of inside trading to me, but then what does this poor angler know? Thank God for Jim Donafrio, The RFA, the FRA, Dennis O'Hern,Gary Poyssick, The Online Fisherman, the comments to threads on The Online Fisherman, Florida Sportsman, 2 Cool Fishing, the Hull Truth, Congressman Walter Jones, countless others and U.S. Sen. Kelly Ayotte, a New Hampshire Republican, who stated, what is echoed everywhere, on Council meeting and Catch Shares, “that it has never been VOLUNTARILY, nor ever suggested.” I do not believe the courts even know it is a voluntary program and the onslaught of commodities being bought, sold, leased and traded on an inside market, to a privileged few. They do now!

IFQ's (Catch Shares); Do They Work?

Under the direction of Dr. Jane Lubchenco’s NOAA, catch shares have become her Achilles' heel to most of the general public, Waterman, Charter Captains and recreational anglers, not to mention the trickle down economics in closing bait shops to boat builders. Then there are those to whom reflect her attitudes, having adopted IFQ's as a mechanism to make the nation's fisheries a sustainable resource, regardless to who it sinks. To this, there is still light at the end of the tunnel, according to a press-release of recent, published in the journal Proceedings of the National Academy of Sciences, by the Lenfest Ocean Program, IFQ's can result in a more consistent - or stable - fishery but do not necessarily improve ecological conditions. It could be summed up with a statement by Dr. Tim Essington, of the School of Aquatic and Fishery Sciences at the University of Washington in Seattle, Washington; "Many proponents of catch share programs presume that they improve the health of fisheries, but our research indicates a much different expectation: They work very well to avoid erratic swings. They generally do not lead to more fish to catch, as catch shares are one potential method for improving fisheries management, but we shouldn't expect these programs to be a panacea;” a term used figuratively as something intended to completely solve a large, multifaceted problem. NOAA, PEW and the EDF along with their working henchmen the Councils of the Pacific, Gulf and Atlantic all believe, Catch Shares are a one fix all solution, no matter the science that is or is not behind it, with a “...build it and they will come” attitude! 
 
The Lenfest Ocean Study Program is the most current, in-depth, comprehensive catch share evaluation in North America today. In a nutshell, it stated that IFQ's or Catch Shares help stabilize swings in fish landings and populations, but do not result in larger fish populations. They then must be of benefit to the stakeholders but not to saving fish. This study, which was actually bought and paid for by the Pew Environment Group, was not to their hopes and was thus discarded like by-catch. The study evaluated 15 Catch share participants in the United States and Canada, looking at factors such as population fishing rate, status and landings. Comparisons between fisheries with IFQ's and without them were evaluated and before to after the implementation of a catch share to them. 
 

Brian Rothschild, of the University of Massachusetts School of Marine Technology and Science, was exasperated at NOAA in its adaptation of catch shares. At a fishing forum held in New Bedford, Mass., Rothschild publicize NOAA's decision to IFQ's as, “ this policy is adopted illegally and hurried along without proper planning and analysis. It is difficult to consider the catch share system as having any function other than economic allocation as its sole purpose,” he stated, according to the Gloucester Times. Continuing with thoughts pertaining to Magnuson-Stevens Brian Rothschild said “conservation and management measure shall have economic allocation as its sole purpose. Projecting this trajectory to the end of the fishing year places the crisis in bold relief as we translate these dry statistics into lost livelihoods and collapses of small businesses.”He also, at another time suggested that Catch Shares were an "experiment conceived in blithe ignorance that is on track to wreak unnecessary cultural, social and economic havoc.”

An example in answering the question of 'Do catch Shares work', might be in the letter sent from Massachusetts Gov. Deval Patrick, to U.S. Commerce Secretary Gary Locke, in correlating the economic problems of the Northeast Groundfish catch share program to its reality; 10 percent of the boats had acquired 65 percent of the fishing revenue, while 90 percent of the boats shared the remaining 35 percent! Catch shares, which is a system that rations shares, or percentages of, in a total allowable catch to individual fishermen, have been used around the world, for years but before these catch shares came to be, economic feasibility studies were done for each and every affected area. IFQ's are generating controversy as to whether they lead to better environmental stewardship over the present systems in place or other fishery management options. As IFQ's are being put into place now, it is too quick, to fast, to soon without further study. One should never gamble with the environment because once you change something, it may take years to recover, if at all. There are ways to which IFQ's do work but not as an across the board solution. Tell your Congressman, Representative or news media that you are a voter. Fishing Politics is important to you and your 25 million brothers and if IFQ's are put into place without all points considered first, well, you lost my vote and someone out there is bound to listen!

Think About Catch Shares, Sector Separation & R.I.C.O.

When it was passed in 1970, the RICO Act was primarily intended to eliminate the influence of the Mafia in the nation's economy. Though today, it could as well be compared to eliminating the NOAA's control of the fisheries, through the Trust Funds set up by PEW and the EDF. This should be the first priority of the U.S. Justice System.
Research shows that advocacy, community organizing, and civic engagement by nonprofit groups makes a substantial, measurable difference in the lives of families and communities. Nevertheless, many philanthropists harbor the view that working with government is not an effective or appropriate role for them to play, and they mistakenly believe that U.S. law prohibits them from doing so.
Philanthropy is fine when it is in bed with the government for reasons to help and benefit mankind. If on the other hand, an organization is involved with criminal infringement of intellectual property rights, it walks a fine line to the tune of R.I.C.O. to which much ado about nothing can be about something and PEW along with the EDF are dancing a tune with NOAA in possible infringement of the Jones Act as well RICO. Would not wish to be in their boat anytime soon. 

We need to educate the non-fishing public. They think we’re just out here slaughtering fish and that isn’t what this is about. We’re trying to make a living and we’re trying to keep fishing,” Logan continued, citing the Alaskan crab fisheries that left 200 boats to dwindle down to approximately 15, in a time when our 'President' has said, “Not in America, we will preserve Jobs, Create Jobs and strengthen the Union!” hm, sounds like JOB LOSS TO ME!

That is a whole lot of Government! 
NOW THINK R.I.C.O. and how these terms could reflect to and within the fisheries industries from Catch Shares, Sector Separation and closures of various fish on the whim of old flawed data to no data at all in driving the prices of fish up and driving the Waterman out! 
Courts look more favorably upon RICO claims based upon true criminal behavior, such as bribery, kickbacks, extortion, obstruction of justice, and clearly criminal schemes that are advanced by the use of the mails and wires.
  • A RICO claim cannot exist in the absence of criminal activity. “South Atlantic Fisheries Management Council had even admitted to having flawed data on which they based potential limits and closures.” Could this be construed as a criminal act?
  • RICO addresses long-term, not one-shot, criminal activity. The formation of councils with bought and paid for Representative of EDF in voting regulations and rules in their favor in different councils and times might fall and apply here too.
  • A RICO claim may be barred by the statute of limitations if you discovered or reasonably should have discovered your injury four or more years ago. It is happening now, has in the past and I believe it passes this question too.
Now if there is a way to use the internet, as that is how they communicate and somehow introduce this into mail and wire fraud statutes, we would sink them!



Although the RICO Act can be used in many contexts, the statute is most easily understood in its intended context: NOAA. In the context of the NOAA, the defendant person (i.e., the target of the RICO Act) is Dr. Jane Lubchenco. The "racketeering activity" is the criminal activities in which NOAA engages, e.g., extortion, bribery, loan sharking, Catch share sales, false documentation, etc. Because the NOAA family has engaged in these criminal actions for years, the criminal actions constitute a pattern of racketeering activity. The government can criminally prosecute the Jane Lubchenco under RICO and send her to jail even if Jane Lubchenco has never personally killed, extorted, bribed or engaged in any criminal behavior. Jane Lubchenco can be imprisoned because she operated and managed a criminal enterprise that engaged in such acts. Moreover, under section 1964(c) of the RICO Act, the victims of the NOAA family (i.e., the extorted businessman, the employers whose employees were bribed, debtors of the loan shark, the family of a murder victim) can sue Jane Lubchenco civilly and recover the economic losses they sustained by reason of the NOAA's pattern of racketeering.
As a practical matter, the closer a plaintiff's case is to the Mafia scenario described above, the better chance the plaintiff has in succeeding under the RICO Act. Given the diverse factual scenarios that may confront attorneys and parties under RICO, it is always helpful to analogize non-Mafia factual scenarios to the prototypical RICO claim against the Mafia. It is always helpful to ask: who stands in the position of the Godfather, i.e., the defendant person? What is the equivalent of the Mafia family, i.e., the enterprise? This will give you a good start in evaluating the merits of any RICO claim you confront. If the facts are well-suited to the Mafia analogy, you likely have a stronger claim.

It has been said that the need to prove racketeering activity essentially requires a plaintiff or prosecutor to prove a crime within a CRIME. A plaintiff or prosecutor has no chance of proving the "greater" CRIME, i.e., the RICO violation, unless they can first establish a "lesser" crime, i.e., an act of racketeering (sometimes called a predicate act).
A RICO claim cannot exist in the absence of criminal activity. The simplest way to put this concept is: no crime - no RICO violation. This rule applies even in the context of civil RICO claims. Every RICO claim must be based upon a violation of one of the crimes listed in 18 U.S.C. s 1961(1).






Section 1961(1) of the RICO Act lists all of the crimes upon which a RICO violation must be predicated. Spool, 520 F.3d 178 at 183. A RICO claim can be predicated on not only numerous federal criminal violations, but also on violations of certain state criminal laws. With regard to the state crimes, the RICO Act states that a violation can be predicated upon "any act or threat involving murder, kidnapping, gambling, arson, robbery, bribery, extortion, dealing in obscene matter, or dealing in a controlled substance . . . which is chargeable under State law and punishable by imprisonment for more than one year." Thus, to prove a RICO claim, a plaintiff or prosecutor must first allege and prove an entire murder case, kidnapping case, arson case, robbery case, etc. Only if the evidence supports these "lesser" charges, can the plaintiff or prosecutor proceed with the remaining elements of the "greater" RICO claim, e.g., pattern, enterprise, operation and management. A RICO claim can also be predicated upon the violation of many, many federal criminal statutes. The federal crimes relate to a number of areas, including: counterfeiting, extortion, gambling, illegal immigration, obscenity, obstruction of justice, prostitution, murder for hire, interstate transportation of stolen property, and criminal infringement of intellectual property rights. These are but a few of the areas of federal criminal law out of which a RICO claim can arise.
Mail and Wire Fraud
The extensive use of RICO in the civil context is almost solely attributable to the inclusion of mail and wire fraud as predicate acts. Sedima, S.P.R.L. v. Imrex Co., 473 U.S. 479, 500 (1985). The mail and wire fraud statutes essentially make it criminal for any one to use the mails or wires to advance a scheme to defraud. Note that the fraudulent statements themselves need not be transmitted by mail or wire; it is only required that the scheme to defraud be advanced, concealed or furthered by the use of the U.S. mail or wires. See 18 U.S.C., sections 1341, 1343. Because every business or corporation in the United States uses the mails or wires to make money, any business who allegedly engages in common law fraud arguably violates the federal mail and wire fraud statutes. As a result, almost any business that allegedly engages in common law fraud can theoretically be sued under the RICO Act.
    1. Extortion
What laypeople call extortion, lawyers call a violation of the Hobbs Act. The Hobbs Act states:
    Whoever in anyway or degree obstructs, delays, or affects commerce or the movement of any article or commodity in commerce, by robbery or extortion or attempts or conspires so to do, or commits or threatens physical violence to any person or property in furtherance of a plan or purpose to do anything in violation of this section shall be fined under this title or imprisoned not more than twenty years, or both. As used in this section: (1) The term "robbery" means the unlawful taking or obtaining of personal property from the person or in the presence of another, against his will, by means of actual or threatened force, or violence, or fear of injury, immediate or future, to his person or property, or property in his custody or possession, or the person or property of a relative or member of his family or of anyone in his company at the time of the taking or obtaining. (2) The term "extortion" means the obtaining of property from another, with his consent, induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right. (3) The term "commerce" means commerce within the District of Columbia, or any Territory or Possession of the United States, all commerce between any point in a State, Territory, Possession, or the District of Columbia and any point outside thereof, all commerce between points within the same State through any place outside such State and all commerce over which the United States has jurisdiction.
18 U.S.C., section 1951 (emphasis added). In essence, the Hobbs Act elevates all but the simplest acts of robbery and extortion to the level of federal crimes.
      1. Extortion under Color Of Official Right JANE'S BOAT?
Many people are confused by extortion "under color of official right." Extortion under color of official right occurs when an agent of the government uses his or her legitimate governmental powers to obtain an illegitimate objective. For example, a police officer may have the authority to revoke a driver's license but he cannot offer to forego the legitimate exercise of his power in exchange for sexual favors from the driver. Likewise, a city council member may have the authority to rezone an area of town and thereby effectively put a company out of business, but the council member cannot threaten rezoning unless the company contributes to his re-election campaign. As one court recently stated: "In order to prove Hobbs Act extortion 'under color of official right,' 'the [plaintiff / prosecutor] need only show that a public official has obtained a payment to which he was not entitled, knowing that the payment was made in return for official acts." United States v. Urban, 404 F.3d 754, 768 (3d Cir. 2005) (quoting Evans v. United States, 504 U.S. 255, 268 (1992)). In short, governmental agents have a great deal of discretion when deciding how to exercise the powers of the government. When a government agent engages in extortion "under color of official right," he is essentially using the governmental powers with which he has been trusted to gain personal or illegitimate rewards.
  1. CONSPIRACIES TO VIOLATE RICO - SECTION 1962(d)
    A RICO claim is broad but a RICO conspiracy claim is even broader. Anyone who agrees or conspires to pursue the same criminal objective can be held liable for a RICO violation. Salinas v. United States, 522 U.S. 22, 63-64 (1997). "If conspirators have a plan which calls for some conspirators to perpetrate the crime and others to provide support, the supporters are as guilty as the perpetrators." Id. at 64. A conspirator must simply intend to further an endeavor which, if completed, would satisfy all elements of a civil RICO claim. Id. at 65. Thus, there are two ways to effectively defend against a RICO conspiracy claim: 1) the defendant must prove he never intended to further the criminal endeavor; or 2) the defendant must prove that the endeavor did not satisfy the elements of a civil RICO claim. Because the first defense is fact based, it is seldom an appropriate defense to raise in a dispositve motion. The best way to undermine a claim for conspiracy on a dispositive motion is to undermine the legal sufficiency of the allegations supporting the substantive offense. See Howard v. American Online Inc., 208 F.3d 741, 751 (9th Cir. 2000) (a claim under section 1962(d) may not stand unless the plaintiffs can sustain a viable claim under another subsection of section 1962).
